exceptionaly angry

My boss is putting me on formal warning for "bad organisation" straight after the conversation we had last tuesday when i mentioned greivence procedure to him as he's treating me like crap, SOOO pissed off by this as his argument is i dont right enough stuff down, and i dont work hard enough but he'll willingly spend his entire day browsing EBAY, time for a new job i think.

Don't be hasty, what you need to do is continue working for him until he makes your working conditions intolerable then send him a letter saying you consider yourself to be constructively dismissed, (see a solicitor) then take him to an industrial tribunal for compensation.

This all depends on how bloody minded you are not everyone could stand the hassle ( I could if I thought he was being unfair ) and if you won that would definately be a bonus and make him think twice before treating someone else like s...

I did this many years ago and won, it wasn't easy, but watching him try to wriggle and squirm his way out of it was extremely satisfying.

hmmm not a bad idea, but then you get the problem of getting a new job without getting a referance from the previouse one.

True but would he give you a good reference if you just left ?

No idea, but it's illegal to actualy give a bad referance he probably just wouldn't give me one. So again i'll just find a new job then do the greivance thing i think.

A good reference from a previous employer is just as likely to be acceptable to a new employer. I know they generally like it to be from the most recent one but it's not a hard and fast rule. You could say you left because of a clash of personalities and feel that he wouldn't give you a fair reference, after all you wouldn't be telling lies.

I felt the same some 30 years ago thats why I went to a solicitor. I had never heard of constructive dismissal and when he told me about it , and wrote the letter, for me to sign I thought he was joking. I'm sure if this law applied 30 years ago it must still exist, but as I said you could see a solicitor, where I live they used to do a legal surgery and although they won't comment on specific cases they will tell you how to go about it and possibly give you a list of relevent law firms, this service used to be free.
or you could try your local citizens advice bureau they may point you in the right direction.

It might be worth speaking to your Personel Manager (assuming it's not your manager) about this. They are supposed to act as an impartial third party if requested to do so.
Or if you've got one, your union rep?

That's true, but I think you'll find when push comes to shove they are afraid of losing their job so tend to pussyfoot around. suppose it depends on how large the company is and do you have a union rep. I wasn't suggesting he follows my idea but go down all avenues before quitting his job and if he must quit why go without a fight, personally I think thats half the reason companies get away with treating their staff like s... very few people are willing to stand their ground,I don't blame them, it is difficult not to just throw in the towel.The company I had this battle with had no union etc and everyone was afraid of the boss/owner, he made my life hell, he tried every trick in the book to get me to leave , I'd seen him do this to countless people before me and decided that I was going to give him a battle and hopefully teach him that not all people can be treated like idiots.It was a long hard battle but for me personally it was worth it and I would do it again if I thought there was just cause.

Wonder if this sort of attitude is why all my various managers are afraid of me ? sometimes when they try to start on me I only have to look at them and they just go err ok never mind Laughing

From personal experience also. I also advise you to speak to a solicitor. You are being harshly treated specifically because you have raised the grievance issue with your manager.

I would advise, ball ache that it is, that you document all conversations / meetings / passing comments (relevant to the grievance and disciplinary issues) and also get a copy of your company disciplinary and grievance procedure to ensure that he has followed the correct guidelines. If they haven't got one you can use the acas website to find out your rights and also what procedures timescales they should have followed.

Apologies for disagreeing on a previous issue but it is not illegal to provide a negative reference but an employer can be legally held to account for any statements that may detrimentally affect a potential new employers view of you as a potential employee. You also have the right to see a reference that has been provided if you feel it has adversely affected any job application.

From the viewpoint of an employee and employer who has experienced both grievance and disciplinary procedures, I would advise honesty to a potential new employer on your current situation but do not make personal comments as this sounds like a personal attack. Even if the person in question is an absolute w*nker try and make the new employer focus on your positive points within the new role.

Sorry for the lecture, I feel for your position as it was personally the worst period of my working life. Remember it isn't personal and the opinion of people who don't matter doesn't matter. Ar*eholes will invariably do this to lots of people and not just to you.

If he wants to play silly-buggers with you, stand up to him and hit him where it hurts, people who throw their weight around and use these tactics (complain about them and they try to screw up your carreer) can't stand it when you beat them at their own game (using the rules and the law).

basically cus of procedures it wasn't possible to actualy perform any disiplinary, as such we had a meeting to discuss my prospects. Not much apart from that still looking for another job though Smile
